This came up in another forum I post out, and I realize not everyone may be aware of this. If you are employed in the U.S., and you work more than 40 hours in a work week (Sun-Sat) for every hour you work over 40, you are federally mandated to receive 1.5x your normal hourly wages.

(This is exempt if you are salaried.)

If you are not being compensated properly for your overtime, and can document it by old pay stubbs, or can get your company to give you old time cards/pay stubbs, what have you (I beleive they are required to do so if you ask them for them) they are also federally mandated to give you back pay for the time they have not paid you for.

If you are getting screwed, make it stop. If they won't give you what you deserve, it is very easy to sue them to get the money back, as it is an easy win.

Hopefully our President won't be a moron and put a stop to overtime pay like he's been talking about. :x

just to clarify, the work week doesn't have to run from Sun to Sat. It can be any of the days as long as its one week's time.

Also, if you're at a seasonal job (i.e. resorts or themeparks) then you'll have to work more than 45 hours to get overtime pay.

I thought he (Bush) was looking to cut down allowed hours of salaried people, and not let them work overtime, forcing companies to hire hourly employees to complete work that companies are making salaried employees do to save money.

I could be wrong on that, but I thought that was the plan. If that is the case, it'd make more OT for hourly people, and it would also create jobs, and lessen the stress of salaried employees.

I'm pretty sure he wants to get rid of overtime pay completly. The plan you stated sounds kinda crazy. I'm going into the hopsitality field (hotels and restaurants) where practically every manager (salaried) works over 50 hours a week. If the govt said we could't work more than 40 that would cripple the entire industry.

From what I understand the plan is to give the option of overtime pay or time off for the overtime worked, or something like that. I don't think the plan is to completly do away with overtime, just give other options.

I know that isn't the case, Rom. They will be increasing overtime benefits for a lot of people, and I'm 90% sure that service industries will not be affected, unless they are making over $70,000 a year, I think, or it might be $65,000. It has been a long time since those news stories, so I'm going to have to do some looking on the web, but I know they are not cutting overtime completely.

There will be some cuts in overtime, but again, it isn't related to the people who are usually eligible for overtime. They are also expanding overtime somewhat. Those expansions will not equal the cuts, but the people who do get overtime will be better off. And like I said, in most cases if you're eligble for overtime now, you will be after, and more besides.

Anything you've heard about drastic overtime cuts or removals are completely wrong, and are probably overly dramatic to cause more anti-Bush sentiment for the election. Basically what they are doing is reoptimizing the overtime regulations to fit the economy. The last time it was done was in the early '70s and the wage data and regulations for who qualifies are all out of whack. People who are not eligible for overtime now because they make too much now (there is a federal cap) will now be eligible, because obviously inflation has occurred and people make more money now. Before they weren't federally protected for overtime, and now they will be. That sort of thing is what is going on.

Basically, anyone that makes less that $23,660 a year is eligible for overtime, regardless of what they were salaried at. I told you this was going to be a very good thing.

So does this mean that if they are expected to make more than $23,660 for the year they don't get overtime?

Possibly. There are three things that have to be met to make someone not eligible for OT. If any of the other three are not met, then you're eligible for overtime. If all three are met, then you are considered exempt and are not eligible. The biggest requirement is wages, though.

And the wages thing is only for salaried employees. If your hourly, your automatically guaranteed overtime. But if you are salaried, and making less than that then you are still eligible for OT, regardless of the normal salary exclusions.
